1. Agreement to Terms

By accessing or using QuickSpoil ("Service"), operated by QuickSpoil, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Your access to and use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy.

2. Description of Service

QuickSpoil is an AI-powered platform that provides insights, summaries, character analyses, and answers about movies, TV shows, and books. Our Service includes:

• AI-generated summaries with customizable spoiler levels (Lite, Medium, Full)
• Interactive Q&A system for story-related questions
• Search functionality for movies, TV shows, and books
• User accounts with favorites, library, and preferences
• Free and Pro subscription tiers with different features and limits

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You can register using Google OAuth or email. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. You may delete your account at any time through your account settings.

4. Subscriptions and Payments

4.1 Subscription Plans

QuickSpoil offers Free and Pro subscription plans:

• Free Plan: Limited features with Lite and Medium spoiler levels, restricted daily usage
• Pro Plan: Full access to all spoiler levels, unlimited daily usage, and additional features

4.2 Billing

• Pro subscriptions are billed monthly or annually in advance
• Payment is processed securely through Polar
• Polar acts as our Merchant of Record and manages applicable taxes and compliance obligations
• All fees are in U.S. dollars unless otherwise stated
• Prices may change at any time, but changes will not affect your current billing period
• You will be notified of price changes before they take effect

4.3 Renewal and Cancellation

• Subscriptions automatically renew at the end of each billing period
• You can cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial billing periods
• We reserve the right to offer refunds or credits at our sole discretion

4.4 Usage Limits

Free plans have daily usage limits for summaries and Q&A requests. Pro plans have higher or unlimited limits. We reserve the right to enforce these limits and may temporarily restrict access if limits are exceeded.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Collect or harvest user information without consent
• Use the Service to generate content for commercial purposes without authorization
• Attempt to circumvent usage limits or subscription restrictions

6. AI-Generated Content

6.1 Content Accuracy

Our AI-generated summaries and answers are created using advanced language models and may contain inaccuracies, errors, or outdated information. While we strive for accuracy, we do not guarantee the correctness, completeness, or reliability of any content generated by our Service.

6.2 Content Sources

Our AI generates content based on publicly available information from sources including Wikipedia, TMDb, Open Library, and other databases. Content is generated dynamically and may vary between requests.

6.3 Use at Your Own Risk

You acknowledge that any reliance on AI-generated content is at your own risk. We are not liable for any decisions made based on information provided by our Service. Always verify critical information from original sources.

6.4 Content Feedback

We encourage users to report inaccuracies through our feedback system. While we review feedback and work to improve our Service, we do not guarantee that all reported issues will be resolved.

7. Intellectual Property

7.1 Service Ownership

The Service and its original content, features, and functionality are owned by QuickSpoil, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content

You retain ownership of any content you submit, post, or display on the Service (such as feedback, reviews, or saved content). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for operating and improving the Service.

7.3 Third-Party Content

Our Service may display or link to third-party content (such as movie posters, book covers, or external websites). We do not claim ownership of such content, and respective owners retain all rights. Use of third-party content is subject to their terms and policies.

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or availability of the Service
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy of AI-generated content

We do not guarantee that the Service will meet your requirements or that any errors will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKSPOIL, INC. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages resulting from your use or inability to use the Service
• Damages resulting from AI-generated content or errors in such content
• Damages resulting from unauthorized access to or alteration of your data

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless QuickSpoil, Inc. and its affiliates from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Our Service integrates with third-party services including but not limited to Google (OAuth), Polar (payments), TMDb, Open Library, Wikipedia, and AI providers (Google Gemini, Anthropic, OpenAI). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the United States.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuickSpoil regarding the Service and supersede all prior agreements and understandings.
